What does CAN-SPAM do?

CAN-SPAM is the USA law that covers the whole email communication for business. What are the restrictions of CASL on email outreach?

CASL sets strict rules for commercial emails sent in Canada. Identification must be clear (name, business details, and any third-party names involved), consent settings must NOT include pre-checked boxes, express consent must be obtained from the recipient, and a 10-business-day unsubscribe process must be provided in accordance with most CASL mandates.


What do the requirements of GDPR say?

GDPR has regulations on the protection of personal data in the European Union. Recipients must give their explicit consent. Under no circumstances would business emails be sent to the potential recipient without any information, but only to public, widely accessible information, such as LinkedIn. The information of who sent the emails and why they are sending them must be there. Recipients must be able to unsubscribe with ease and have the right to view or remove their info.


How does LOPD differ from GDPR?

The LOPD has many similarities with the GDPR while adding some more: only business emails from publicly available sources, contacts checked against Spain's Lista Robinson (people who have opted out), reasons for outreach clearly related to business, and a focus on starting conversations.


CAN-SPAM, GDPR, CASL, and LOPD are all rules that fight for fairness and the protection of individuals' private information. Basically, they verify your identity, affirm other people's interests in your talk, and make it fairly straightforward for them to direct you to stop.
